Time to Lawyer Up!

I’ve said previously I don’t think legal action would work because how do you prove it affected the result. However, this isn’t going back to Tesco for a refund on some broken custard creams. We are talking millions of pounds.

If the legal advice indicates we are entitled to compensation then it would be negligent of the board not to pursue that
 
Villa deserve to stay up..can't dispute that going by their run - in form.
Your as big a club as those in the Elite group.. so to hell with it....Hope you get to Win the Title again in the near future.
We had some good battles with you..and managed a couple of wins ...so as with 1972 we are in your history !

Big club, nowhere near the size of the elites though. Mid to upper table prem - Everton trophy contenders.
 
In the ladies World Cup the referee went and looked at the pitch side monitor and made a decision from that.

Is that facility not available to the referee if a situation like that happens?

How can the ref go and view the pitchside monitor if he wasn't made aware of the situation by the idiots in charge of VAR in the first place? Which appears to be what the article is saying.

How about we come to a reasonable out of court settlement and we can forget all about this unfortunate matter. Tell you what, sort this out amicably, and we'll even name the new stadium after you ! Best thing for Football is bloody Hawk- Eye and VAR are jettisoned now...before things get worse...if we went to Court for that Outcome ..yeah go for the big one...otherwise we are wasting our pride and prejudice.
Non- League Football is looking more and more attractive to many !

Since it will be hard to actually PROVE anything one way or another I think it really will come down to "hush money" if we kick up enough stink in pursuing it.

"Here's a few quid to brush this embarrassing incompetence under the carpet if you promise to go away quietly like a good little football club".

It happens all the time, so if we have the opportunity to earn some "hush money" we might as well go for it. Every little helps.
 
However..... Hawk-Eye has admitted that they fecked up and apologised. Surely, admitting fault should carry consequences?

This is the key point for me. Hawk-Eye has ‘apologised unreservedly to all those affected’. Certainly worth exploring the prospect of compensation.

... So Villa are Bigger in my book... and they sit in the Second City in our most industrial area..so should be able to match Manu long term.

From watching the game at the time the referee was very much aware of what happened, just by his reaction and pointing to his watch.

Nearly everyone else saw it and the players were complaining as they knew the ball had crossed the line.

But just saw this.

After the match Hawk-Eye came out with a statement, saying, "seven cameras located in the stands around the goal area were significantly occluded by the goalkeeper, defender and goalpost."

Allow me to point out that after Sheff Utd, you had ELEVEN matches in which to scrape enough points to stay up, that’s 33 available points you had left to play for. Your club needs to grow up and accept that over the course of the season, you didn’t warrant a place in next years Premier League.
 
It was an outrageous moment. But a predictable one, as soon as technology was introduced into the game there was going to be an error.

But that’s what some people wanted and now we have to live with it.

Personally I don’t think we have much of a complaint, we signed up to the terms that’s that. -17 wasn’t fair either but ultimately you had to sign up to the terms to be involved.

We should move on with a statement saying it’s media palava and that we were never considering it - which could be the case anyway.

Are you thick ? We are talking about FINANCIAL COMPENSATION here. There is a precedent since in a similar situation financial compensation was awarded to Sheffield United after they were relegated by West Ham who broke some rules. That is all. A legal precedent and the possibility of applying for compensation on similar grounds. It has nothing to do with football and all to do with business. Any business would be negligent not to seek compensation if there is any possibility that they may be entitled to it. Nobody is asking for the relegation to be annulled.

The legal outcome would depend upon matters which we as fans have no knowledge of.

Which division of Hawk Eye did the PL contract to buy the technology from? We assume it was England but if for any reason it was their American office all bets are off. The U.S. has a much more expansive tort doctrine and, to paraphrase the club motto, in U.S. courts "anything is possible".

Who are the contracts between? Bournemouth may not have standing to sue if they as a corporate entity were not party to the contract.

I'm glad the Board is apparently taking advice on this. There are a number of issues involved specific to the contract in play here. If there is even a slight chance of victory I presume the Board will go forward and attempt to settle out of court. Hawk Eye can not afford to take a loss in court.

One question: We know we are rid of VAR next year. Is Hawk Eye relegated to our past as well in the Championship?

I propose the FA sues FIFA for Frank Lampard’s disallowed goal v Germany in the 2010 World Cup, in fact sod it, while we’re at it, let’s take them to the cleaners for allowing Maradona to fist the ball over the on rushing Peter Shilton at Mexico 86......ffs
