Time to Lawyer Up!

I kind of agree with @NWCherries98 and @redharry on this... Whilst I do think moaning about relegation is sour grapes, this is nothing to do with us trying to get reinstated to the PL... This is about a club that has just lost £100m saying we were relegated by a technical mistake and for that we need you to compensate us...

As I've mentioned before, for those that argue we were relegated because we weren't good enough... well you've kind of reinforced the argument to sue Hawkeye... Because you can just as easily argue that technically we should have stayed up, because we were good enough to have finished 4th bottom...

The season is played over every minute of every game... Right to the last... It's not just about being good enough to be beyond relegation with 10 games to go and assuring safety...

Sheffield Utd (I think) got around £20m over the Tevez situation, so translate that into current monies, and you could be looking at double that in compensation...

So yes, go get your money if it is just about easing the pain of losing £100m, but lets not argue to be reinstated to the PL...

As long as we make it clear that we are not questioning the final results of the league but are solely seeking compensation for the loss of PL money as a result of negligence by Hawkeye, I don't think anybody would call it sour grapes on our part. There is a precedent for this type of compensation after all !

Of course I would prefer it if we just let it lie, but it's not my potential 20-30 million at stake here. If the legal advisors agree that AFCB have a case, then it would be worth pursuing. I still think however that the fact that Villa may have got a draw or victory even if the goal had been allowed to stand will make it impossible to prove that the mistake cost us one league position. If it had happened with the last kick of the game then maybe. But as it happened with plenty of the match still to be played, it's very hard to argue that it was a decisive mistake which contributed directly to our relegation.

If I were on the board I would seek the best legal advice available. If they think we have a case, then we absolutely should pursue it. If not, we just forget about it and move on.

Plenty of people suggesting that we should just leave it or move on because we dont know what would have happened had the goal been given, and whether villa will have pushed for an equaliser.

If that’s the rationale for not mounting a legal claim then answer me this - where was the proof that West Ham would not have signed someone else had they not signed Tevez, or that another one of their 6 other strikers would not have scored the goal against Man Utd that kept them up at Sheff Utds expense? For those that have forgotten, Sheff Utd received a £20m+ payout, and that was back in the days when the tv revenue was half what it is now.
 
The biggest decision I want to see after the board meeting is not about Hawkeye, but that Eddie Howe and Max and the rest of the board have agreed that Eddie Howe will lead us into next season.

So hopefully then it will be onwards and upwards.

The problem with that is proving negligence. It's not just a matter of proving that they were wrong, because we all know that they were wrong. Negligence means that they were wrong because the Hawkeye people did something stupid, careless, incompetent, or they sold a device that wasn't fit for purpose, or basically just messed up for no reason.

If Hawkeye can persuade the court that the system isn't perfect and they didn't claim it was perfect but it's the best they could make it and it would work 99.9% of the time and this was the 0.1%, then they win their case.
 
Do you think they had a call on Monday from claims direct(there are others available) say we could claim for you and we would take 40% of your winnings with no win no fee

If the ball was in the centre circle and the ref watch showed "goal" this would be overturned by the ref or VAR, how come when this situation happened, why didn't the ref overturn his decision at halftime once he saw the mistake ?

It was turned on, so that's not an issue. I suspect if it wasn't turned on it might be the PL's issue anyway, not Hawkeye's.

As for why the ref didn't overturn it at half time, it's because he isn't allowed to. They have never been allowed to look at TV and change the decisions after the event.

Shame this wasn't the same at Burnley with our two goals !!! so VAR can and the ref can't...................crazy, remember these words............"clear and obvious error"

As a Villa fan watching the entire game, West Ham certainly weren't p*ssing about. At the end of the game they were lumping it forward going for the win as if they needed it to stay up.
 
The only outcome of a legal challenge that would fit the Hype. .would be Bournemouth reinstated in the PL..at Villas expense....fair, but too much of an upheaval and its just not going to go that way is it ?
It would take a very big clubs big league lawyers to get anywhere near that outcome.

If this is true what exactly were the idiots in charge of VAR doing? Having a nap?

Surely any right minded person in charge of VAR ought reasonably would have flagged up the fact that the ball was clearly over the line to the referee?

Also if true, does the idiots in charge of VAR apparent failure to notify the referee of this constitute negligence?

I would be very interested to receive an answer from a legally qualified person to my question.

In the ladies World Cup the referee went and looked at the pitch side monitor and made a decision from that.

Is that facility not available to the referee if a situation like that happens?

Don't talk daft, we just want a few quid. It's a real possibility that we were up sh*t creek financially with relegation anyway but throw covid reductions in transfer values to the mix and we could be facing financial oblivion. They should do all they can to mitigate.

Villa deserve to stay up..can't dispute that going by their run - in form.
Your as big a club as those in the Elite group.. so to hell with it....Hope you get to Win the Title again in the near future.
We had some good battles with you..and managed a couple of wins ...so as with 1972 we are in your history !
